Terms of Service

Welcome to MacroForge ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the MacroForge mobile application, website at macroforge.fitness, and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

IMPORTANT: These Terms contain an arbitration agreement and class action waiver. Please read Section 14 carefully.

You must be at least 18 years old to use the Service. By using the Service, you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws
• If using blockchain features, you are legally permitted to hold digital assets in your jurisdiction

MacroForge provides a fitness and nutrition tracking platform including:

• Calorie and macronutrient tracking
• AI-powered food recognition and logging
• Workout logging and exercise tracking
• AI pose analysis and form feedback
• Supplement and medication tracking
• Social features and community interaction
• Optional blockchain-based rewards and token features

The Service is provided for informational and tracking purposes only. MacroForge is not a medical device and does not provide medical advice.

You acknowledge that:

• MacroForge does not provide medical, nutritional, or fitness advice
• Nutritional information and calorie counts are estimates
• AI recommendations are for informational purposes only
• You assume all risks associated with using the Service
• You are solely responsible for decisions based on the Service

IF YOU EXPERIENCE ANY ADVERSE HEALTH EFFECTS, DISCONTINUE USE AND CONSULT A MEDICAL PROFESSIONAL.

5.1 Nature of $FORGE Tokens

• $FORGE tokens are NOT securities, investments, or financial instruments
• $FORGE tokens are NOT redeemable for fiat currency from MacroForge
• $FORGE tokens have no guaranteed value and may become worthless
• Token features may be modified, suspended, or discontinued at any time

5.2 Wallet Responsibility

• You are solely responsible for your wallet and private keys
• Lost private keys cannot be recovered by MacroForge
• All blockchain transactions are final and irreversible
• You are responsible for all gas fees and transaction costs

5.3 No Investment Advice

Nothing in the Service constitutes financial, investment, legal, or tax advice. Consult qualified professionals before making financial decisions.

• Subscriptions are billed in advance on a recurring basis
• Subscriptions automatically renew unless cancelled
• You may cancel at any time through account settings or app store
• No refunds for partial subscription periods
• For App Store/Play Store purchases, their refund policies apply

You retain ownership of content you submit. By submitting content, you grant MacroForge a worldwide, non-exclusive, royalty-free license to use such content in connection with the Service.

You agree not to:

• Violate any applicable laws
• Submit false or misleading information
• Harass, abuse, or harm other users
• Attempt unauthorized access to the Service
• Manipulate or exploit token rewards fraudulently
• Use bots or automated tools
• Reverse engineer the Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties including:

• Implied warranties of merchantability and fitness
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding accuracy of nutritional data or AI recommendations
• Warranties regarding value or availability of $FORGE tokens
• Warranties regarding blockchain network performance

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACROFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING:

• Loss of profits, revenue, data, or use
• Personal injury or health issues from use of the Service
• Loss of cryptocurrency, tokens, or digital assets
• Failed or incorrect blockchain transactions
• Unauthorized access to your account or wallet

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) AMOUNTS PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100.

You agree to indemnify and hold harmless MacroForge from claims arising from your use of the Service, violation of these Terms, or use of blockchain features.

We may terminate your account at any time for any reason. Upon termination, your right to use the Service ceases immediately. Any $FORGE tokens or points may be forfeited.

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.

Binding Arbitration: Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association.

Class Action Waiver: YOU AND MACROFORGE AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

If you access the Service through the Apple App Store:

• These Terms are between you and MacroForge, not Apple Inc.
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for product warranties
• Apple is not responsible for any claims relating to the Service
• Apple and its subsidiaries are third-party beneficiaries of these Terms
